If you are a liberal and you are not planning to vote for President Obama, I have two words for you: Supreme Court. If you are considering a vote for a third party presidential candidate like Jill Stein of the Green Party, or if you are thinking of not voting at all, I would like to remind you that the Supreme Court already leans conservative 5 to 4.

Commonwealth Court Judge Robert Simpson ruled Tuesday that Pennsylvania cannot enforce it’s voter ID law before the election. The ruling can be appealed to the state Supreme Court but that appears to be unlikely since it was the highest court in PA that sent the law back to the lower court with instructions to do what it has now done. This is a big win for voting rights in Pennsylvania and the country. However, the law still exists and could be enforced at a later date. So there is still work to be done.

Nine cast members of “The West Wing” (NBC, 1999-2006) reunite for a four-minute mini episode titled “Walk and Talk the Vote.” The mini episode actually serves as an informational ad instructing voters about filling out the “non-partisan” section of their ballot, as well as a campaign ad for Bridget Mary McCormack who is running for Michigan Supreme Court. She is the sister of actress Mary McCormack, who was a West Wing cast member from 2004 through 2006.

I can’t help but think the Pennsylvania Supreme Court wanted to take the easy road on this ruling when they decided to send the Voter ID case back to a lower court for reconsideration. That means the law is still in effect but is pending yet another court review. The lower court has until October 2nd to issue a ruling.

Today the Pennsylvania Supreme Court heard arguments over the state’s strict — I mean, discriminatory — voter ID law. The case is on appeal from a lower court ruling. Unless overturned by the PA Supreme Court, the voter ID law is set to be enforced this election day, November 6th, potentially disenfranchising hundreds of thousands of PA voters.

Lawrence O’Donnell pointed out something on his show tonight that never occurred to me. The Democratic Party has won the popular vote in all but one presidential election since 1992. That’s 4 of the last 5, and it includes the 2000 presidential election that was awarded to Republican George W. Bush by the Supreme Court (he lost the popular vote to Al Gore).

E.J. Dionne has a great piece in the Washington Post: The Founders’ true spirit. In it he writes, “Differences over policy are often disguised as differences over whether a preferred choice is constitutional or not. When we should be addressing pragmatic questions — Will this approach work? Will it solve the problem it’s designed to solve? Is this a problem government should do something about? — we instead fall back on rather abstract discussions of whether a given idea violates the Constitution.”
